Terms of Service

Draft pending legal review. These Terms replace the previous US-style agreement for subscribers in the European Economic Area, the United Kingdom and Switzerland. They are not final until counsel confirms them. If translations diverge, the English text prevails until an Italian version is counsel-approved.

1. Agreement to Terms

By accessing and using MazaLabs ("the Service"), you agree to be bound by these Terms of Service ("Terms"). If you disagree with any part of these terms, you may not access the Service.

2. Description of Service

MazaLabs provides AI-powered e-commerce automation services, including but not limited to:

  • WhatsApp Business API integration and automated messaging
  • Package tracking and delivery notifications
  • AI-powered customer service responses
  • E-commerce integration, website builder and order management
  • Analytics and reporting tools

3. User Accounts

Account Creation

  • You must provide accurate and complete information when creating an account
  • You are responsible for maintaining the confidentiality of your account credentials
  • You must be at least 18 years old to create an account
  • One person or entity may not maintain multiple accounts to evade these Terms

Account Responsibilities

  • You are responsible for all activities that occur under your account
  • You must notify us immediately of any unauthorized use of your account
  • You may not share your account credentials with others

4. Subscription Plans and Billing

Billing Terms

  • Subscriptions are billed monthly or annually in advance
  • You may upgrade or downgrade your plan at any time; changes take effect as described at checkout
  • We will give at least 30 days' notice of material pricing changes
  • You are responsible for all applicable taxes, except where we are required to collect them

Refunds and statutory withdrawal

  • Consumers in the EEA/UK/CH: if you qualify as a consumer under applicable law, you have a statutory right of withdrawal from a distance contract within 14 days of concluding the subscription, unless you have expressly requested that performance begin during the withdrawal period and acknowledged that you lose the right once the service has been fully performed. Contact support@mazalabs.com to exercise this right. A model withdrawal form is available on request.
  • Outside that statutory right, fees are generally non-refundable except where required by law, or in cases of documented service failure or billing error attributable to us.
  • Failed payments may result in service suspension after notice

5. Acceptable Use

You may not use the Service to send spam, violate laws, infringe intellectual property, transmit malicious code, or interfere with the Service. Use the Service for legitimate business purposes in accordance with these Terms.

6. Data and Privacy

  • You retain ownership of your data
  • Where we process personal data on your behalf as a processor, that processing is governed by our Data Processing Agreement (accepted separately) and our Privacy Policy
  • We implement appropriate security measures to protect data under our control

7. Service Availability

We strive for high uptime but do not guarantee uninterrupted service. We may perform scheduled maintenance and are not liable for interruptions beyond our reasonable control.

8. Intellectual Property

The Service and its original content are owned by MazaLabs. You may not copy, modify, or distribute our proprietary content. You grant us a limited licence to use your content solely to provide the Service.

9. Limitation of Liability

Nothing in these Terms excludes or limits liability that cannot be excluded or limited under applicable law (including liability for death or personal injury caused by negligence, or for fraud). Subject to that: we provide the Service on a commercially reasonable basis; our aggregate liability arising from the Service in any twelve-month period is limited to the fees you paid us for the Service in that period; and we are not liable for indirect or consequential damages to the extent permitted by law.

If you are a consumer, mandatory consumer protections in your country of residence prevail over any conflicting limitation above.

10. Termination

You may cancel your subscription at any time; cancellation takes effect at the end of your current billing period unless a statutory withdrawal applies earlier. We may suspend or terminate your account for material violations of these Terms after notice where reasonably practicable, or discontinue the Service with reasonable notice.

11. Governing law and disputes

These Terms are governed by the laws of the State of Wyoming, United States, without regard to conflict-of-law rules, except that:

  • If you are a consumer habitually resident in the EEA, the United Kingdom or Switzerland, mandatory consumer-protection rules of your country of residence continue to apply, and you may bring proceedings in the courts of that country.
  • Business subscribers (non-consumers) agree that the state and federal courts sitting in Wyoming have exclusive jurisdiction, subject to any mandatory law that cannot be waived.

We do not require binding arbitration or a class-action waiver from EEA/UK/CH subscribers. Nothing in these Terms forces you to waive rights that mandatory law preserves.

12. Changes to Terms

We may modify these Terms. For material changes affecting EEA business subscribers we will give at least 15 days' notice where Regulation (EU) 2019/1150 applies, and otherwise reasonable notice by posting the updated Terms and/or email. Continued use after the effective date constitutes acceptance, except where mandatory law requires a different mechanism.
